China 301 Tariff Update


List 4 Tariff Exceptions Announced

Earlier today, the USTR released official information on the imposition of List 4 tariffs. We are pleased to share that the efforts of JPMA and our member companies have paid off. Of particular note, the exception from List 3 for finished car seats has been maintained for List 4, which means no tariffs will be imposed on this category.


  • List 3 goods, with the exception of finished good car seats (HTS Codes 9401.80.6021 and 9401.80.6023) and all other juvenile product exceptions as granted on List 3, are now subject to tariff imposition as outlined in List 4. Review the list here.
  • List 4 has been divided into two parts. List 4A and List 4B.
  • Items on List 4A will be subjected to a 10% tariff effective September 1, 2019.
  • Items on List 4B will be subjected to a 10% tariff effective December 15, 2019.
  • Juvenile Product HTS codes appearing on List 4A and 4B can be reviewed here.
  • There will be an exclusion request process for List 4. We will share those details as soon as they are available.

 What We Need from You:

  • If you previously submitted HTS codes to JPMA for List 3, please review the updated list to see (in yellow highlight) which of those codes are now subject to tariff under List 4 because they will no longer qualify for exemption.
  • It is imperative that you review List 4 (starting on page 7) and send your impacted HTS codes and corresponding product descriptions to Meredith Birkhead at ASAP. We will continue to track submitted HTS codes should we need this data in the future.
  • Per the schedule below, consider submitting public comment or appearing to testify at the public hearing. If you plan to do either or both, please let JPMA know. We will circulate a draft of our written comments shortly so that members may use similar language.
  • Contact your representatives!  Find your representatives here. Using your zip code, look up your elected officials and send a personalized version of the draft letter JPMA has prepared by using the mailbox icon.  Feel free to also call your representatives office directly.
  • In addition to your own cost increases, we need you to start your analysis of what the cost increase to the consumer will be with the 25% tariff imposition -- how much, by category, will retail costs increase?  We need this information to support our communications strategy and to support a compelling argument for exclusions.
