Vermont Chemical Disclosure Program Update

Over the past several months, the JPMA team has been providing updates on what to expect from Vermont with regard to its Chemical Disclosure Program.

The new rule goes beyond Washington State's Children's Safe Products Act chemical reporting program by requiring manufacturers of children's products containing any of the 66 "chemicals of high concern" to children to report the chemicals' presence in their products, identified by brand name and product model. The regulation was put forth under a 2014 law (Act 188) authorizing the chemical reporting program. 


Most notably, this program will require product reporting, including product name and model number. For a brief overview, please refer to Serlin Haley's presentation that was given during JPMA's annual summit in Washington, DC.

JPMA has actively advocated both during the passage of the law and again during the rule-making for greater consistency with other states and for companies to be able to use the same data from state to state. 

As expected and discussed over the past several months, the Department informed us recently that the Chemical Disclosure Program online reporting system is now available for use.For access to the system, visit

Please note that the reporting deadline is January 1, 2017. See 18 VSA 1775 as amended.Manufacturers are required to provide disclosures to the Department by this date.

The Department will provide a walk-through of the system via webinar. Invitations to the webinar will be sent to the email update list. If you are interested in participating, please notify JPMA's Director of Regulatory and Legislative Affairs, Mark Fellin at as soon as possible. The webinar will also be recorded and made available on the Chemical Disclosure Program website.


We encourage you to test the system and notify us of any problems you are having. This will greatly help us in our ability to document concerns with the proposed system.
