JPMA Supports Coalition Efforts to Keep Safe Juvenile Products Available in Albany County

The Juvenile Products Manufacturers Association (JPMA) today announced its support of the Safe to Play Coalition’s complaint against Albany County for its passage of a law that will ban the sale of most children’s products in the county. The lawsuit filed in Federal District Court asks that the law be declared unconstitutional and allow the products that meet strict federal safety standards remain available to consumers. The Safe to Play Coalition represents hundreds of U.S. based manufacturers and sellers of juvenile products and toys.

Local Law J bans and criminalizes the sale of safe toys and products that otherwise meet federal safety laws under the Federal Hazardous Substances Act (FHSA) and the Consumer Product Safety Act (CPSA). The lawsuit alleges, the county acted with “gross disregard of extensive federal laws regulating the safety of toys and children’s products” and failed to adhere to the U.S. Constitution.  The law suit not only reaffirms the safety of children’s products under the oversight of federal regulators and law but also asks for an injunction from the court. 

“This law does nothing to improve safety,” said JPMA Executive Director Kelly Mariotti. “The only thing this law does is negatively impact parents, caregivers and the businesses that serve them.”       

Juvenile products are one of the most heavily regulated product categories in the country having to meet hundreds of tests and standards before being made available for sale. In addition to FHSA and CPSA, The Consumer Product Safety Improvement Act (CPSIA) specifically incorporated additional requirements for juvenile products, creating mandatory federal safety regulations for 18 different product categories. JPMA is not only actively engaged in this regulatory process but the voluntary regulatory process of ASTM.         

“Safety is our number one priority. It is incorporated into everything we do and the products our members produce,” added Mariotti.

JPMA supports the Safe to Play Coalition, preserving a family’s ability to have access to safe children’s products and defending safety not only in Albany County but across the country.
